The decriminalization of Marijuana will be a new challenge for all HR professionals in Illinois, Wisconsin, Iowa, and Indiana. The wonderful state of Illinois being one of the first adopters of the sea change of the decriminalization marijuana is daunting. This will present a whole host of legal concerns to come forth once an employee challenges a post accident and/or a pre-employment drug screen. Zero Tolerance policies may become mute and unenforceable once the state decriminalizes the recreational use of weed. I see that this challenge will test all the norms/standards that most employers have adhere regarding personal recreational drug use of their workforce. This prospect will require you to do a fresh look at those policies to see if they are still relevant moving forward. Please comment below on how you think this will affect your workplace.
